NIGHT FISION LIMITED LIFETIME WARRANTY

Night Fision Arms, LLC warrants that products manufactured by Night Fision Arms, LLC will be free from defects in material and workmanship during normal use during the lifetime of the original owner; provided, that green and yellow tritium vials are only warranted to remain illuminated for sixteen (16) years from the date of manufacture and other vial colors are only warranted for a period of five (5) years from date of manufacture. ANY ATTEMPTED TRANSFER OF THIS LIMITED WARRANTY WILL RENDER THIS LIMITED WARRANTY NULL AND VOID.

This Limited Warranty does not apply to any products that have been damaged by abuse or misuse. Review your sights for tritium illumination and other manufacturing defects before installing or making any sight modifications. FAILURE TO USE PRODUCTS FOR ANY PURPOSE OTHER THAN NORMAL USE WILL VOID THIS LIMITED WARRANTY.

Many Night Fision, LLC products contain Tritium and are regulated by the Nuclear Regulatory Commission (NRC). As a result, purchasers are not permitted to disassemble any Night Fision, LLC products. ANY ATTEMPT TO DISASSEMBLE OR REPAIR A PRODUCT WILL VOID THIS LIMITED WARRANTY.

If a product fails to operate during the warranty period, Night Fision, LLC will, at its option, replace or repair the defective product or grant the original purchaser a credit towards a replacement product. If Night Fision, LLC provides a replacement and the original product is not available, a comparable product will be provided. Prior to receiving a replacement or refund of any products, the original purchaser must return to Night Fision, LLC the defective product. Night Fision, LLC reserves the right to replace discontinued models with the current production replacement for an upgrade fee. This fee will be billed to the original purchaser upon replacement. Night Fision, LLC will not be responsible for labor costs of product removal or installation. For avoidance of doubt, “to replace the product” does not include any removal or reinstallation costs or expenses, including, without limitation, labor costs or expenses, shipping costs to return non-conforming products or any damages that may occur during the return of product to Night Fision, LLC.

The agents, dealers and employees of Night Fision, LLC are not authorized to make modifications to this Limited Warranty, or additional warranties binding on Night Fision, LLC about or for products or components thereof. Additional statements, whether oral or written, except signed written statements from an officer of Night Fision, LLC, do not constitute warranties and should not be relied upon.

Please be advised any product purchased from a 3rd party seller will have warranty voided. Warranty only applies to items purchased directly from Night Fision.

This Limited Warranty shall be governed by and construed and interpreted in accordance with the laws of the State of Michigan, without regard to its conflicts of laws principles. By accepting the product, purchaser and hereby irrevocably consents to the exclusive jurisdiction of the State and Federal courts sitting in the State of Michigan with respect to any claim or other matter arising out of or related to this Limited Warranty.

THE FOREGOING LIMITED WARRANTY IS THE SOLE AND EXCLUSIVE REMEDY FOR ANY AND ALL CLAIMS, IN CONTRACT, IN TORT OR OTHERWISE ARISING FROM THE FAILURE OF PRODUCT AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ALL WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WHICH WARRANTIES ARE HEREBY EXPRESSLY DISCLAIMED (IT BEING UNDERSTOOD THAT, EXCEPT FOR THIS LIMITED WARRANTY, THE PRODUCT HAS BEEN SOLD ON AN “AS-IS” BASIS. THE LIABILITY OF NIGHT FISION, LLC SHALL BE LIMITED TO THE TERMS OF THE EXPRESS WARRANTY SET FORTH HEREIN. IN NO EVENT WILL NIGHT FISION, LLC BE LIABLE FOR ANY PUNITIVE, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES INCLUDING, WITHOUT LIMITATION, DAMAGES RESULTING FROM LOSS OF USE, PROFITS, BUSINESS OR GOODWILL, WHETHER OR NOT NIGHT FISION, LLC HAS BEEN ADVISED OF THE POSSIBILITY THEREOF.
